What is the Difference between Assault and Battery
Crimes are of different nature and obviously the charges against them are very different as well. Actually, the charge against any crime depends upon the nature and intensity of crime. Some crimes have similar nature and it becomes very difficult to differentiae the charges against them. Same case is true for the crimes “Assault” and “Battery”. These crimes have similar nature but having vast difference in terms of charge. Here are some key differences between “Assault” and “Battery”. So, read them and make your concept clear in your mind.
Assault
Assault is a crime causing a victim to fear violence. An assault involves an intentional, unlawful threat to cause bodily injury to another by force. The charge of assault is applied only, if the victim has been threatened only and not touched by criminal.
Battery
The extreme stage of assault charge is called battery. When a person commits a crime comprising illegal physical contact, he is charged by battery. The exact definition of battery is that, it is volitional act and the aim behind this act is to do a harmful contact with any other person intentionally or creating such atmosphere, which would be feasible for committing physical contact.
Assault vs Battery
Both assault and battery are crime charges, but they are different from each other in a very clear manner. Assault and battery are differentiated in this respect that former is just the threat of committing violence and the later one is the practical form of this threat. The impact of assault on affected person is the development of fear for being injured and the result of battery is physical injury itself. This physical contact could be in either form and very minor or ignorable contact is also included in battery charge like spitting on anyone’s face.
